Service Agreement

Between

ChinaTravel.One (hereinafter referred to as “Agency“)

And

The buyer (Name/Group) (hereinafter referred to as “Traveler“)

Effective Date: 


1. Parties

  • Agency: China Travel One, registered in Denmark at Henrikshave 66, 2950 Vedbæk, with business license number DK27790496.
  • Traveler(s): Individual(s)/Group participating in the tour arranged by the Agency.

2. Scope of Services

The Agency agrees to offer the services for the Traveler’s trip to China:

  • Tour Arrangements: Itinerary planning, sightseeing tours, and activity bookings as specified in the agreed-upon itinerary (attached as Appendix A).
  • Transportation: Domestic flights, trains, buses, or private transfers within China as outlined in the itinerary.
  • Accommodation: Hotel bookings or other lodging as specified in the itinerary.
  • Guides: Licensed bilingual guides for tours and assistance.
  • Other Services: Visa support documentation (if applicable), meal reservations, and emergency support.

3. Traveler’s Responsibilities

The Traveler agrees to:

  • Give precise personal information (e.g., passport details, dietary restrictions, medical conditions) required for bookings.
  • Follow all laws, regulations, and customs of China during the trip.
  • Obtain valid travel documents (passport, visas, health certificates) before departure.
  • Buy comprehensive travel insurance covering medical emergencies, cancellations, and repatriation.
  • Inform the Agency promptly of any changes to contact details or travel plans.

4. Payment Terms

  • Total Fee: [Insert Amount] per traveler, payable in [Currency].
  • Deposit: 30% of the total fee due upon accepting this agreement.
  • Balance Payment: The remaining 70% due no later than 14 days before tour begins.
  • Payment Ways: Bank transfer, credit card, or other agreed-upon method.
  • Extra Costs: The Traveler bears costs for personal expenses, optional activities, or changes to the itinerary.

5. Cancellation & Refunds

  • By Traveler: Cancellation ≥14 days before the tour begins: Full refund (excluding non-refundable deposit).
  • By Agency: Full refund if the Agency cancels due to force majeure (e.g., natural disasters, political unrest).
  • Force Majeure: Neither party is liable for cancellations due to unforeseeable events beyond their control.

6. Liability Limitations

  • The Agency is not liable for:
    • Losses due to the Traveler’s negligence or failure to follow law.
    • Acts/omissions of third-party service providers (e.g., airlines, hotels).
  • The Agency’s liability is limited to the total fee paid by the Traveler.

7. Dispute Resolution

  • Disputes shall first be resolved through friendly negotiation.
  • Disputes that stay unresolved shall go to the China International Economic and Trade Arbitration Commission (CIETAC). Arbitration will be conducted in Beijing, China. The process complies with Chinese law.

8. Governing Law

This agreement is governed by the laws of the People’s Republic of China.


9. General Clauses

  • Amendments: Changes need written agreement by both parties.
  • Entire Agreement: Supersedes all prior discussions.
  • Severability: If any clause is invalid, the rest remains enforceable.
